The Aberdeen, SD city council will discuss a proposed ordinance that targets “pit bulls” at their meeting on Monday, December 10, 2012. The item is #6 on the council agenda, and is slated for a possible first reading.
We learned a few weeks ago that the city council agreed to revisit the city’s animal control ordinance after the issue was brought up by a resident at a recent council meeting. Members of the city council are extremely divided on the idea of banning specific breeds of dogs, and have asked city employees to gather more information. Councilman Clint Rux also requested information regarding the costs of a breed specific ordinance, and indicated that without the addition of another animal control officer, the ordinance would be unenforceable.
Its interesting to note that the only fiscal issue related to the ordinance mentioned in the city council packet is the cost of a microchip scanner. As we know, the cost of enforcement of a breed specific law is extremely costly to taxpayers, as well as taxing on a city’s other resources. In addition, the city contends that if a pet owner doesn’t agree with the city’s conclusion that their dog is a “pit bull,” that pet owner may provide additional information, including DNA testing, which the board will take into consideration. PLEASE NOTE, the burden of proof lies on the city to prove the dog is a “pit bull” and, therefore, subject to the ordinance — it is NOT the burden of the dog owner.
